In 1992, the United States Patent and Trademark Office granted Future Sonics (Pineville, Pa.) a federal registration for the Ear Monitors trademark. Since then, the company continues to enforce this trademark.

According to Daniel East, director of marketing for Future Sonics, "We, as a business, are simply monitoring any potential confusion in the marketplace that might occur by similar references to our brand. Therefore, any use of the words 'ear' or 'ears' and 'monitor' or 'monitors,' used concurrently, will be understood as a direct violation of our trademark rights. We are pleased to see that competitor companies like Shure, Sennheiser, Crest and others are either accommodating our rights or working to do so. We try to respect the branding of every company and only expect the same in return."

Future Sonics has retained the services of trademark-enforcement law firm Kenyon & Kenyon to advise on the continuous protection of its valuable trademark. According to the attorneys, violations could include packaging, advertising and other uses where the "ears" and "monitors" terms may appear together.
